Terms of Service

1. Welcome

Welcome to Next Chapter Notes (“NCN”, “we”, “us”). We provide daily encouragement via SMS text messages. By using our service, you agree to these Terms of Service (“Terms”).

2. Subscription & Billing

• Plan: SMS Plan — $5/year (covers carrier delivery costs).
• Billing: Payments are processed securely by our payment provider (e.g., Stripe). We do not store your full card details.
• Auto-renewal: Subscriptions renew annually unless canceled before the renewal date.
• Price changes: We may update pricing for future terms. We’ll notify you in advance where required.

3. SMS Program Terms

• Message frequency: 1 message per day.
• Content: Short, uplifting notes intended to encourage and support you. No unrelated advertisements.
• Consent: Your explicit opt-in is required for SMS delivery. Consent is not a condition of purchase of any other goods or services.
• Charges: Message and data rates may apply depending on your mobile carrier plan.
• Opt-out: Reply STOP to end SMS delivery, or unsubscribe via your Member Dashboard, or contact us at nextchapternotes@nextchapternotes.com.
• Help: Reply HELP for assistance, or email us anytime.
• Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.

4. Cancellations & Refunds

• You may cancel at any time in your Member Dashboard or by contacting support.
• Unless required by law, we do not offer pro-rated or partial refunds for the remaining term after cancellation.
• Canceling stops future auto-renewals and future messages after your current term ends (or immediately if you also opt out of SMS).

5. Eligibility & Account

• Minimum age: You must be at least 13 years old to use the service.
• Accuracy: You agree to provide accurate contact and billing information and keep it up to date.
• Security: You are responsible for safeguarding any credentials used to access your account.

6. Acceptable Use

You agree not to misuse the service (e.g., attempting to disrupt operations, reverse engineer systems, automate sign-ups in a way that causes abuse, or use the service for unlawful purposes). We may suspend or terminate access for violations of these Terms or suspected abuse.

7. Privacy

8. Disclaimers

Our messages are for general encouragement only and are not medical, legal, financial, or professional advice. If you need professional help, please seek it. The service is provided “as is” and “as available.” We do not guarantee that messages will be delivered without delay or error, as delivery depends on carrier networks and other factors.

9. Limitation of Liability

To the fullest extent permitted by law, NCN and its affiliates will not be liable for any indirect, incidental, special, or consequential damages, or any loss of data or profits, arising out of or related to your use of the service. Our total liability for any claims arising from or related to the service shall not exceed the amount you paid to us for the current subscription term.

10. Changes to the Service or Terms

We may modify or discontinue features of the service and update these Terms from time to time. If we make material changes, we will provide notice (e.g., via site notice or email). Continued use after the effective date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Venue for any disputes shall be in courts located in California, unless applicable law provides otherwise.
